This document is a product template draft and does not constitute legal advice. Replace every placeholder before public release, and have qualified counsel review it.

1. Acceptance

These Terms are an agreement between you and KcalNow (“we”) regarding the KcalNow mobile app and related website services. By signing in, using the service, or agreeing to these Terms and the Privacy Policy in the App, you agree to be bound by them.

If you disagree, stop using the service.

2. Service description

KcalNow provides features that may include meal photo capture / recognition, estimated calories and related data, cloud food-log sync, scan reminder pushes, same-day diet tips, streak and meal-quest habit features, weekly report display and (for subscribers) sharing, free-tier ads, and paid subscriptions.

Important:

• Recognition results, calorie figures, and diet tips are for personal reference only and are not medical advice, diagnosis, treatment, or nutrition prescriptions. Do not use them as a substitute for licensed medical or nutrition professionals.
• We may improve features and, within reason, change, interrupt, or discontinue parts of the service.
• Free users may face daily recognition limits and ads. Subscribers receive entitlements described in the product (for example ad removal, higher recognition quota, weekly share)—as shown in the App.

3. Accounts

• You sign up or sign in with Sign in with Apple and must keep your device and Apple ID secure.
• You are responsible for activity under your account. Unauthorized use of others’ accounts, and selling, renting, or sharing accounts, is prohibited.
• The App provides account deletion. After deletion, cloud data is handled as described in the Privacy Policy and may be unrecoverable.
• If you notice anything unusual, contact support@mealnow.top. We may temporarily restrict an account when we reasonably suspect a security risk.

4. Acceptable use

You agree to use the service lawfully and not to:

• Upload or distribute illegal, infringing, or harmful content;
• Disrupt the service or attempt unauthorized access to systems, data, or other users’ information;
• Abuse recognition, push, APIs, or automated malicious requests;
• Bypass subscription checks, forge entitlements, or interfere with ads and quotas;
• Reverse engineer the App except where mandatory law allows;
• Use the service for high-risk or medical decision-making and then claim liability based on that use.

We may warn, limit features, suspend, or terminate the service for violations.

5. Subscriptions, payment, and refunds

• Paid features are offered through Apple App Store auto-renewable subscriptions (and similar). Price and period are as shown in the App Store and in the App.
• Payment, renewal, cancel, and refund follow Apple’s terms and processes. We maintain server entitlements from Apple transaction proofs and App Store Server Notifications.
• You may cancel auto-renewal in Apple ID subscription settings at any time; after cancel, paid access typically continues until the end of the current period (per Apple rules).
• Restore purchases with the same Apple ID. After device change or reinstall, use in-app Restore and stay signed in so entitlements can bind to your account.

6. Advertising

Free users may see ads served by Google AdMob or similar. Ad content comes from the ad network or its clients. We aim for compliant integration but do not separately warrant third-party ad accuracy or legality. Subscribers may see fewer or no ads per product design.

7. Intellectual property

The App, website, brand marks, UI design, copy, and related software IP belong to us or our licensors. Without permission you may not copy, modify, distribute, or use them commercially.

You retain rights in content you upload and grant us the licenses needed to provide and improve the service (including sending meal images to recognition model providers for analysis). Public food-catalog / vector-library data is part of the service and is not transferred to you by use.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law:

• The service is provided “as is”; we make no express or implied warranties of recognition accuracy or availability;
• We are not liable, to the extent allowed by law, for interruption, delay, or data loss caused by networks, third parties (cloud vendors, model providers, Apple, ad networks, etc.), devices, or force majeure;
• We are not liable for indirect, incidental, or punitive damages arising from your use of the service; any liability cap (if applicable) is limited to fees you paid us for the related service (or the minimum permitted by law if the service is free).

Some jurisdictions disallow certain limitations; mandatory rules then control.

9. Changes, suspension, and termination

We may adjust service content or rules and announce them on the website or in the App. You may stop using the service and delete your account at any time. We may suspend or terminate service for serious breach, compliance needs, or service wind-down.

10. Privacy

How we handle personal information is described in the Privacy Policy (https://mealnow.top/privacy). That policy applies together with these Terms.

11. Governing law and disputes

These Terms are governed by [Governing law & venue] (placeholder; until the operator’s domicile is fixed, this may temporarily mean the law of the operator’s place of establishment). Parties should try to resolve disputes amicably first; otherwise submit to the courts or arbitration bodies with jurisdiction under that law (exact forum to be set before launch).
